All Drivers providing services through the Platform are employees of the Company. Nothing in these Terms creates a franchise, agency, partnership, joint venture, or employment relationship between the User and the Company beyond that of a service recipient.

The Platform acts as a technology interface to facilitate Rides between Users and Company-employed Drivers. The Company is the operator and provider of transportation services and is not a mere intermediary for third-party transport providers.

Violation of any applicable law
Any material breach of these Terms

Booking Confirmation: A Ride is confirmed only upon successful driver allocation, communicated via the Platform. A booking request does not, by itself, constitute a confirmed Ride.

Rentals: Rental packages are time- and distance-bound as specified at booking. Any usage exceeding the agreed package will be charged at rates prevailing at the time of the Ride.

Refund Abuse Prevention: The Company reserves the right to deny refund requests that are repetitive, lack supporting evidence, or are determined to be made in bad faith. Accounts demonstrating a pattern of refund abuse may be suspended or terminated.

Physical or verbal assault, harassment, or intimidation of the Driver or any other person
Deliberate damage to, soiling of, or vandalism of the Company's vehicle
Transporting live animals or pets without prior written consent from the Company
Distracting the Driver through physical contact or persistent verbal interruption while the vehicle is in motion
Requesting the Driver to violate traffic laws, speed limits, or safety regulations
Collecting or recording the Driver's personal information without consent
Any sexual harassment as defined under applicable Indian law

Vehicle cleaning or damage charges will be assessed and billed to the User's Account in cases of soiling, spillage, or physical damage caused by the User. Such charges are not refundable.

You agree to indemnify, defend, and hold harmless the Company, its directors, officers, employees, agents, successors, and assigns from and against any and all Losses arising out of or relating to:

Any false, inaccurate, or misleading information you provide to the Company
Claims by Third Parties arising from your actions or omissions
Your unauthorised use of another person's Account or payment instrument
Any damage to a Company vehicle caused by you

General Liability Cap: For all claims not involving bodily injury, the Company's total aggregate liability for any single Ride shall be limited to the lesser of: (a) INR 1,000 (Indian Rupees One Thousand only), or (b) the Fare actually paid by the User for the relevant Ride.

Vicarious Liability: The Company accepts vicarious liability for Driver acts performed in the course and scope of their employment. The Company shall not be vicariously liable for Driver acts that are: (a) outside the scope of employment; (b) wilful criminal acts; (c) performed while the Driver is off-duty; or (d) not connected to the provision of the Ride.

The Company employs reasonable safety protocols including Driver background verification, vehicle inspection, and in-app SOS features.

Lost & Found: Users are solely responsible for their personal belongings. If an item is lost during a Ride, the User must report it within 24 hours via the Platform or at support@golivanto.com. The Company will make reasonable commercial efforts to recover lost items but does not guarantee recovery and accepts no liability for loss.
